How did Pacific View go against the building rules that state that high-rises cannot be built on the sea-side of roads ?

The buildings are clearly on the sea-side of Tai Tam Road.

Pacific View successfully argued that a planned road - not an actual road - that had been Gazetted, was enough. So, because of an idea for a road - that may never be built - Pacific View was able to worm their way through a loophole and build their high-rise.
